These Terms and Conditions govern your access to and use of the services provided by Swadeshi Mangoes, operated by Swadeshi Mangoes LLC (“we,” “us,” or “our”), through our website, WhatsApp platform, and city-wide pickup network.
By placing an order with us, you agree to these Terms and Conditions.
1. Services Provided
Swadeshi Mangoes provides pre-order access to Indian mangoes and other seasonal fruit products through a network of city-based pickup agents across Texas and other service areas.
Customers may place orders online and receive updates through WhatsApp, email, text message, or phone call.
2. User Responsibilities
By placing an order, you agree:
- To provide accurate contact, billing, and pickup information
- To ensure that your phone number and email address are valid and accessible
- To make payment through the approved payment methods listed at checkout, including Zelle or cash where available
- To pick up your order within the designated pickup window after receiving notification
- To inspect your order at the time of pickup and notify the pickup agent immediately if there are any issues
We are not responsible for orders that are not collected within the pickup timeframe provided.
3. Pickup Policy
Customers are responsible for collecting their orders from the selected pickup location within the pickup period communicated by Swadeshi Mangoes.
If an order is not collected within the specified pickup period:
- We may not be able to guarantee fruit quality
- Storage may not be available beyond the pickup deadline
- The order may be considered abandoned without refund
Pickup agents are independent coordinators assisting with distribution and are not responsible for issuing refunds or making decisions regarding disputes.
4. Cancellations and Refunds
Orders may be cancelled up to 24 hours before the shipment arrival date or designated pickup date.
After that time, cancellations are not guaranteed because mango shipments are imported, limited, and often allocated in advance.
Refunds may be issued only in the following situations:
- The order could not be fulfilled
- The order was not delivered to the selected pickup location
- The fruit was significantly damaged or spoiled at the time of pickup
- There was a major error in the order
Refund requests must be made within 24 hours of pickup and should include photographs where applicable.
Refunds will not be issued for:
- Minor cosmetic imperfections common with fresh fruit
- Delays outside our control
- Dissatisfaction based on personal taste preferences
- Fruit that was damaged after pickup due to improper storage or handling
5. Limitation of Liability
Swadeshi Mangoes is not responsible for:
- Delays caused by customs, weather, airlines, cargo delays, suppliers, or pickup agents
- Product availability issues due to seasonal supply limitations
- Personal allergic reactions or medical conditions related to fruit consumption
- Damage caused after pickup
- Spoilage caused by improper storage after pickup
- Missed pickups or incorrect information provided by the customer
Our maximum liability for any order shall not exceed the amount paid for that order.
6. Communications Consent
By placing an order, you consent to receive communications from us regarding:
- Order confirmations
- Pickup notifications
- Shipment updates
- Payment reminders
- Service announcements
- Promotional offers and future mango season updates
These communications may be sent through WhatsApp, SMS, email, or phone call.
You may opt out of promotional communications at any time by contacting us. However, you may still receive important service-related messages regarding active orders.
7. Privacy and Customer Information
We respect your privacy and take reasonable steps to protect your personal information.
Customer information collected may include:
- Name
- Phone number
- Email address
- Pickup location
- Order history
- Payment details where applicable
We do not sell customer information to third parties.
Customer information may be shared only with pickup agents or service providers when necessary to complete your order.
8. Payment Processing
Payments made through our website are securely processed by Stripe. We do not store or have access to your full credit card or debit card information.
By making a payment, you agree to Stripe’s terms, privacy practices, and payment processing policies.
Orders are not considered confirmed until payment is successfully completed or otherwise approved by us.
9. Force Majeure
We are not responsible for delays or failure to perform caused by events beyond our control, including but not limited to natural disasters, severe weather, customs delays, import restrictions, transportation disruptions, strikes, government actions, or supply shortages.
10. Governing Law
These Terms and Conditions are governed by the laws of the State of Texas.
Any disputes arising from these Terms shall be handled in the appropriate courts located in Texas.
11. Changes to These Terms
We may update these Terms and Conditions from time to time.
Continued use of our services after changes are posted means that you accept the updated Terms.
